CBGB's has to pay back rent (about $54,000), it just doesn't have to pay
the part of the rent that the rent increase would have added to that
over the last three years (about another $54,000). So the owner still
owes around $54,000. It's a bad situation for the club. Especially as
Hilly didn't put the rent he withheld into escrow and appears to not
have it. Plus the owner of the building seems to not want to renew the
lease when it expires at the end of this month. (And appears to want
Crystal to pay the increase for the last three years despite the court
ruling in order to get them to negotiate a new rent.)
So the news isn't as good as it looks.
